By visiting our site and/or purchasing something from us, you are engaging in our "Service" and agree to comply with these Terms of Service (“Terms”), including any additional terms and policies referenced or linked within this page. These Terms apply to all users of the site, including but not limited to visitors, customers, vendors, merchants, and content contributors.

Our website is hosted on an e-commerce platform that enables us to sell our products and services to you.

You may connect to the Services only by using: (a) a bracelet that is manufactured, distributed, or sold by Timond itself; or (b) our software, or approved third-party applications, software, or devices; or (c) our websites (“Authorized Connections”). You may not connect to the Services: (i) with any device that is not manufactured, distributed, or sold by Timond itself (such as a knock off or counterfeit version of a Timond device) or otherwise intends to resemble or purports to be a Timond device; or (ii) through any unauthorized application or third-party connection. Any violation or attempted violation of this provision may result in the immediate termination of your ability to access the Services. 3. Creating An Account 

To access the full range of features that Timond offers, you may be required to create an account. When doing so, you must provide:

  • Your full name

  • A valid email address

  • A strong password

  • Any other information requested to ensure proper configuration of your account

You are fully responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Timond is not liable for any damages or losses resulting from unauthorized use of your login credentials. 4. Necessary Equipment

To fully access and enjoy all features of our Services, you are responsible for using devices that:

  • Have operating systems and software compatible with our Services.

  • Maintain a reliable internet connection.

  • Meet any other technical requirements we specify.

It is your responsibility to:

  • Ensure your devices are properly maintained, updated, and secured.

  • Regularly install security updates and software patches as recommended by device manufacturers or software providers.

  • Protect your devices from malware, unauthorized access, and physical damage.

Please note that the performance and security of our Services may be affected by the condition or setup of your devices. We are not responsible for any issues arising from device malfunction, inadequate software, or insufficient internet connectivity.

5. Posting User-Generated Content On The Services

Some of our Services may allow you to upload, post, share, or store content—such as images, videos, text, comments, and other material (“User-Generated Content”).

You retain ownership of any content you submit. However, by posting it through our Services, you grant Timond a worldwide, royalty-free, non-exclusive, transferable license to use, display, reproduce, modify, and distribute your content for the purpose of providing and improving our Services. This may include using your name and likeness in connection with your content.

You are solely responsible for your content and affirm that:

  • You own it or have the right to share it.

  • It does not infringe on anyone else's rights (including copyright, trademark, privacy, or publicity).

  • It doesn’t violate any laws, promote harm, or contain offensive, discriminatory, fraudulent, or misleading material.

You also agree not to:

  • Upload malicious software or viruses.

  • Access another user's account without permission.

  • Post spam, promotional, illegal, or harmful content.

  • Use the Services in ways that disrupt others or violate our guidelines.

Timond reserves the right to remove or restrict access to any content that violates these Terms or poses harm to users or the platform. We may also work with law enforcement in cases of illegal or abusive content.

6. Timond's Rights

Timond Content” includes all photos, images, graphics, videos, audio, data, text, music, comments, software, creative works, and any other content or materials that are posted, created, provided, or otherwise made available through our Services. Timond Content, the Services themselves, and the underlying technology behind them are protected by United States and international laws relating to copyright, trademarks, trade dress, patents, trade secrets, database rights, and other intellectual property. Timond reserves all rights not expressly granted to you under these Terms. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices that appear on or are embedded within our Services. Our logos, trademarks, and the overall look and feel of our brand—this includes but is not limited to bracelet designs, page headers, graphics, icons, scripts, and user interface elements—are owned exclusively by Timond. These may not be copied, imitated, or used in any form or for any purpose without our prior written consent. Additionally, any third-party trademarks, product names, company names, or logos featured on the Services are the property of their respective owners and may not be used, in whole or in part, without permission from the appropriate trademark holder.

7. What You Can Do On The Services 

The Timond Services are for your personal, non-commercial use only.

Timond grants you a limited, non-exclusive, non-transferable, and revocable license to:

  • Use the Services
  • View Timond content
  • Use our web-app

This license is for personal enjoyment only and must follow these Terms.

You may not copy, sell, distribute, modify, or publicly display any part of the Services or Timond content unless we say otherwise in writing. You also don’t get any rights to Timond’s intellectual property beyond what’s clearly given in these Terms.

Specifically, you’re not allowed to:

  • Copy or recreate our website or app layout without permission
  • Use the Timond name, logo, or brand without written consent
  • Access restricted areas of our systems or those of our partners
  • Test or bypass our security features
  • Use unauthorized methods to access the Services or content
  • Reverse engineer or tamper with our software or code

8. Hyperlinks

We grant you a limited, non-exclusive, and non-transferable right to create a text hyperlink to our Services for non-commercial purposes, as long as:

  • The link does not misrepresent us, our brand, or our products in a false, misleading, or harmful way, and

  • The website hosting the link does not contain any unlawful, offensive, harassing, or otherwise inappropriate content (including adult material).

We reserve the right to revoke this permission at any time, at our sole discretion.

9. Our Enforcement Rights

While we are not obligated to monitor your access to or use of the Services—nor to review or edit any Timond Content or User-Generated Content—we reserve the right to do so at any time to:

  • Operate and maintain the Services effectively,

  • Ensure compliance with these Terms, and

  • Comply with applicable laws or legal obligations.

We may report any unlawful activity to the proper authorities and cooperate with law enforcement as required by law, including responding to valid legal requests or court orders.

At our sole discretion, we also reserve the right (but are under no obligation) to:

  • Remove or restrict access to any part of the Services, including your User-Generated Content or any Timond Content,

  • Disable or suspend your access to the Services at any time and without prior notice—particularly if your use is found to be in violation of these Terms or otherwise harmful, offensive, or objectionable.

We may investigate any suspected violations and take any actions we deem appropriate, including legal action or account termination.

10. Use the Services at Your Own Risk

By using the Services or relying on any content provided by Timond, you do so at your own risk. While we strive to offer helpful, accurate, and up-to-date information, we make no guarantees, endorsements, or warranties—express or implied—regarding the accuracy, reliability, availability, or suitability of the Services or any Timond content, unless specifically stated in our Terms of Sale. The information you receive through our Services may be incomplete, inaccurate, or unavailable at times. It is your responsibility to exercise good judgment and common sense when using the Services or acting upon any information provided. Always follow any safety guidelines or notices that may be included with the use of our products or Services.

11. Staying Healthy with Wearable Devices

Wearing your Timond bracelet or any wearable device continuously can cause skin irritation or allergic reactions in some individuals. To help minimize these risks and keep your skin healthy, we recommend the following care and usage guidelines:

Wear and Care Tips

  • Keep it clean: Regularly clean your device and band to remove sweat, dirt, and bacteria.

  • Keep it dry: Dry both your skin and the device after exposure to water or sweat.

  • Avoid tightness: Wear the bracelet comfortably—neither too tight nor too loose—so your skin can breathe.

  • Give your wrist a break: Remove the bracelet for at least one hour after extended wear to allow your skin to recover.

If You Experience Skin Discomfort

  • Should you notice irritation, redness, soreness, tingling, numbness, burning, or stiffness on your wrist or hand, discontinue use immediately and remove the bracelet.

  • If symptoms do not subside within 2–3 days after removing the device, consult your doctor for further evaluation.

12. Terms of Sale, Returns & Warranty

All purchases made on Timond.co are subject to our Terms of Sale, which are incorporated into and form part of these Terms of Service.

When you place an order, please note that all orders must be reviewed and accepted by Timond. We reserve the right to accept, decline, or limit any order at our sole discretion, for reasons including but not limited to availability, pricing errors, or concerns about fraudulent activity.

13. Feedback & Submissions Policy

At Timond, we always appreciate hearing from our customers. However, we kindly ask that you do not submit any unsolicited ideas, proposals, or suggestions—including ideas for new or improved products, services, marketing campaigns, technologies, or product names. This policy exists to avoid potential misunderstandings or disputes in the event that any of our products, services, or marketing efforts happen to resemble an idea you submitted.

If you choose to submit feedback or ideas to us despite this policy, you agree that:

  • Timond is under no obligation to review, respond to, or consider your submission.

  • The submission will become the exclusive property of Timond, without any obligation to compensate you.

  • Your submission will be treated as non-confidential and non-proprietary.

  • Timond may freely use, reproduce, modify, publicize, or distribute your idea for any purpose, including commercial use, without credit or compensation to you.

This policy also applies to any comments, suggestions, or content shared with us at our request—such as through email, surveys, online forums, or social media channels.

14. Contests & Giveaways 

From time to time, Timond or our promotional partners may run surveys, contests, giveaways, or other special promotions. These promotions may be subject to additional terms and conditions, which will be provided separately. It is your responsibility to read and understand those specific terms before participating. In the event of a conflict between the promotional terms and these Terms of Service, the promotional terms will apply to the extent of the conflict.

15. Alerts & Notifications

When you use our Services, you may receive notifications, text messages, alerts, emails, and other electronic communications. By using the Services, you agree to receive these communications. You can manage your notification preferences at any time through your account settings—however, please note that some essential communications, such as order updates, service notices, or administrative messages, may still be sent as they are necessary for the proper functioning of the Services. Any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that the communication be in writing.

16. Third-Party Services

Our Services may contain links to, or integrate with, third-party websites, applications, services, promotions, or other content (“Third-Party Services”) that are not owned or controlled by Timond. You may also have the option to connect your Timond account, data, or device with these Third-Party Services. These options are provided solely for your convenience, but Timond does not endorse, monitor, or take responsibility for any content, services, or products offered by third parties.

By choosing to use any Third-Party Service in connection with Timond, you understand and agree that:

  • Third-Party Services are entirely separate from Timond’s Services.

  • Timond does not control or guarantee the accuracy, quality, or security of these services.

  • You assume full responsibility and all associated risks when interacting with any Third-Party Service.

Please be aware that these Terms and the Timond Privacy Policy do not apply to any Third-Party Services. It is your responsibility to review and understand the applicable terms and privacy policies before engaging with any third-party providers.

17. Change to the Services

Bond Touch may change or discontinue, temporarily or permanently, any feature or component of the Services at any time without notice. Bond Touch is not liable to you or to any third party for any modification, suspension, or discontinuance of any feature or component of the Services. We reserve the right to determine the timing and content of software updates, which may be automatically downloaded and installed by Bond Touch products without prior notice to you. 

18. Termination

We reserve the right to suspend, deactivate, or terminate your account—or your access to some or all parts of the Services—at any time, for any reason, and at our sole discretion, without prior notice or liability. In the event of suspension or termination, we may also delete or remove any User-Generated Content and related information associated with your account. You may choose to close your account at any time by contacting our Customer Support team. Please note that certain sections of these Terms will continue to apply even after your account is closed or your access to the Services is terminated. These surviving sections include: Sections 1, 5, 6, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, and 24.

19. Disclaimers

The Services and all content provided by Timond are offered "as is" and without any warranties of any kind. To the fullest extent permitted by law, Timond expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, Fitness for a particular purpose,

  • Non-infringement,

  • Quiet enjoyment, and

  • Any warranties arising from course of dealing, course of performance, or usage of trade.

We do not guarantee that:

  • The Services or content will meet your expectations or requirements,

  • Access will be uninterrupted, secure, or error-free, or

  • Any information provided through the Services will be accurate, reliable, complete, up-to-date, or free of defects.

Use of our Services is at your sole risk, and you assume full responsibility for any issues that may result from their use.

20. Indemnification

You will indemnify and hold harmless Timond or its officers, directors, employees, affiliates, agents, licensors, and contractors from and against any claims, suits, actions, demands, disputes, allegations, or investigations brought by any third party, governmental authority, or industry body, and all liabilities, damages, losses, costs, and expenses, including without limitation reasonable attorneys’ fees, arising out of or in any way connected with (a) your access to or use of the Services, (b) your User-Generated Content, (c) your breach or alleged breach of any warranties made by you hereunder or your violation of any other provision of these Terms, or (d) your violation of any law or the rights of a third-party. We reserve the right to assume control of the defense of any third-party claim that is subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

21. Limitation of Liability

To the fullest extent permitted by law, Timond, its suppliers, licensors, and anyone involved in providing the Services will not be liable for any indirect, incidental, special, consequential, or exemplary damages—including lost profits, data loss, goodwill, service interruptions, computer damage, or the cost of substitute services—arising out of or related to your use of the Services, regardless of the legal theory and even if we were advised those damages might occur.

In any case, Timond's total liability for any claim related to these Terms or your use of the Services will not exceed the greater of $100 or the total amount you paid us for the Services (if any). Some locations do not allow limitations on certain types of damages, so these limits may not apply to you.

22. Dispute Resolution

Please read this section carefully—it affects your legal rights.

Most customer issues can be resolved quickly by contacting support@timond.co. Before starting any formal action, you agree to try to resolve any dispute or claim relating to these Terms or our Services with us informally first.

If we can't resolve the dispute within 15 days, either party may pursue resolution through binding arbitration (not a court case), except as noted below. Arbitration will be administered by the American Arbitration Association (AAA) under its rules, and will take place in your county of residence or another mutually agreed location.

  • Governing law: California law manages these Terms and any related disputes.

  • Opt-Out: You may opt out of mandatory arbitration within 30 days of first agreeing to these Terms by contacting us.

  • No Class Actions: All disputes must be resolved individually; class actions and class arbitrations are not allowed.

  • Exceptions: Either party can bring qualifying claims in small claims court or seek injunctive relief for intellectual property or unauthorized use without first going to arbitration.

  • Limitation on claims: All claims must be filed within one (1) year or they are permanently barred.

23. General Terms

These Terms constitute the entire agreement between you and Timond and override any previous agreements about our Services. If we make major changes to these Terms, we’ll notify you and give you a chance to review them. By continuing to use the Services after changes take effect, you accept the updated Terms. If any part of these Terms is found invalid or unenforceable, the rest stays in effect. You may not transfer your rights or obligations under these Terms to anyone else without our written consent. We may transfer ours freely. Notices and updates will be sent by email or posted on the site. Failure to enforce any part of these Terms is not a waiver of our rights.

24. Additional Terms

Additional terms may apply to certain products or services. If there’s a conflict between these Terms and the additional terms, the additional terms will control.
